Drug Trafficking is a global problem that also affects United States. Although the law fights every day with this issue, there are still significant drug trafficking problems in the United States. According to Drug Enforcement Administrations (DEA) there are over 30,000 annual arrests related to distribution and trafficking of illegal drugs.
Drug trafficking or distribution includes transportation, selling and illegal import of controlled substances. Drug distribution is more serious crime as drug possession and is regarded as felony. It is also illegal to distribute prescription drugs like pain killers, sleeping pills etc.
It is well known that drugs are addictive chemical substances that affect central nervous system causing beneficial effects on perception, consciousness and behavior. There are four basic types of drug crimes, these are possession, distribution/trafficking, use and manufacture and cultivation of any of the following:
- anabolic steroids
- chemicals (ingredients of drugs)
One of the basic drug crimes is drug possession, because it is illegal to possess controlled substances such as heroin, cocaine, marijuana, LSD, methamphetamine etc. If a person possesses a small amount of drugs, it may be considered a “simple possession”. If the police finds large amounts of drugs, it presumes “intention to distribute”. Drugs possession can be determined by “actual possession” when the person has control over the drug and in most cases is carrying it. If the substance is found around the person’s property – the possession is called “constructive”. Possession of paraphernalia such as crack pipes, bongs or syringes also violates federal and state laws.
Marijuana is considered an illegal drug, its possession, use, cultivation or sale is prohibited by federal and state law. The term “medical marijuana” refers to legal possession, use and cultivation of cannabis plant for medical reasons.
- epilepsy and others.
California was the first state that legalized medical marijuana in November 1996. You must have a doctor’s recommendation and a license to cultivate and possess it. The doctors that prescribe marijuana and people who use it in limits set by law are free from criminal charges. Nowadays 20 states legalized marijuana for medical purposes, some of them are: Colorado, New-Jersey, Nevada, Massachusetts, Hawaii. Two states made it legal to use marijuana for recreational purposes, these are Colorado and Washington.
According to Drug Enforcement Administrations, there are yearly over 30,000 arrests related to trafficking and distribution of illegal drugs. Illegal Drugs business costs billions of dollars, that’s why this type of crime is always a problem for the U.S. and it is impossible to totally extirpate it.
- Marijuana – 660.969 kg
- Cocaine – 49,823 kg
- Heroin – 598 kg
- Methamphetamine - 1.540 kg
- Hallucinogens – 9.199.693 units
It is estimated that marijuana is currently used by 11.5 million people in the U.S. Most of the marijuana is illegally imported in the United States from Mexico, also a big amount of high-potency marijuana comes from Canada. All of the Cocaine traffic in U.S belongs to Colombian and Mexican organizations. It is estimated that there are over two million cocaine addicts in the United States and the highest percent of cocaine usage belongs to people from 18 to 25 years old.
It is estimated that abuse of drugs and alcohol costs society over $110 billion each year through criminal behavior, unforeseen injuries and death, dependency treatments and other. This is the reason why state and federal laws prohibit the use, possession, trafficking and manufacture of drugs.
Drug manufacture is the process of production, preparation or conversion of controlled substances by means of chemical processes. Drug cultivation means that the person is growing plants that are included in the group of controlled substances, these usually are marijuana, opium or hallucinogenic plants. Drug manufacturing or cultivation is regarded as a more serious crime as drug possession, because it is mostly linked to drug distribution.
Having to go to court for a plant might seem a bit much, especially when the plant we are discussing is marijuana. Understanding the laws of this popular plant is so complicated that even local law enforcement in the state of California can’t seem to understand how to handle this decriminalized herb. Marijuana leading to increase in DUI charges in California has become an issue to the court system and to the individuals receiving the DUI.
Most DUI cases end up leaving the defendant in jail for approximately 3 days while the judge gets to hear the case and decide what the sentencing will be. Facing legal actions for being high on a plant that is known to ease tension should be a crime itself, due to the fact that more and more doctors are being summoned to court after dealing with patients all day to clarify that the defendant is in fact under the prescription of marijuana, and is allowed to smoke this non harmful plant. Driving under the influence of marijuana according to the State of Colorado and Washington is an acceptable thing, and although the Feds never really approved the use of marijuana, state law seems to be passing all kinds of legalities that tells the individual how to operate after smoking marijuana. However, given that the plant has not been fully legalized in California, it is leading to the increase in DUI arrests.
One of the greatest problems in the United States are illegal drugs. The most available, used and distributed drug is marijuana. Each year approximately 800.000 Americans are arrested for violating marijuana laws.
The biggest number of arrests based on possession of at least a pot of marijuana is made in Texas. Even if it is your first conviction, you can get 180 days jail time and a $2000 fine. The state law in Oklahoma allows judges to sentence to life imprisonment people convicted of cultivation of cannabis or for the sale of the smallest amount of it. Annually over 13.000 people get arrested for pot possession in Oklahoma and they are convicted severely.
One of the most widely-spread problem in the whole world are illegal drugs. This refers also to United States. When people get tired or bored of what they have, they want changes, and the easiest way for it is to use drugs. In addition to possession, manufacture and distribution of illegal drugs, drug use is also a crime.
It is illegal to use following substances unless they are legally prescribed by your doctor for health reasons:
- chemicals that are used in production of drugs
- prescription medicines
