Underage Drinking and Minor in Possession

Underage drinkingUnderage drinking problem is a major public health issue in the United States. Adolescents want to overcome social anxiety, lower their inhibitions in social situations, reduce stress and worries, increase courage, feelings and power, enhance sexual attractiveness and performance, satisfy the thrill seeking desires through alcohol consumption. This issue became one of the most well known cause of numerous legal disputes.

Alcohol consumption by youth in the United States (also known as underage drinking) is a term used for the concept of alcohol use by anyone under the minimum legal drinking age of 21. A lot of states have a minor in possession (MIP) – criminal offense concerning alcohol and drugs found in possession of minors, although some details regarding punishments vary from state-to-state. Some states provide a very strict strategy towards those who violate the MIP law and prosecute its felons; others have a different point of view about juvenile justice, providing probation by entering a court-ordered diversionary program and offering medical care. It is typically a misdemeanor for anyone under 21 to possess alcohol. Besides the fact that this is the minimum legal age to buy alcohol in all states, details tend to vary.

Cost of Obtaining Medical Records is the Latest Obstacle in the Pursuit of Medical Malpractice Claims Against Imprisoned Michigan Oncologist Dr. Farid Fata

Imagine losing a family member or loved one to what you thought was a cancer related death.  One day you read in the newspaper that the Oncologist, Michigan doctor Farid Fata, has been charged with massive Medicare fraud, including giving $35 million in needless chemotherapy to patients. Now you are questioning whether or not the treatments provided by Dr. Fata were in fact even necessary and if those treatments could have been the cause of death.

Jeff Burrs lost his father to kidney failure which occurred during chemotherapy treatments that had been prescribed by Dr. Fata.  Mr. Burrs is now requesting his father’s medical records from Crittenton Hospital in Rochester and has learned the following:

  • Request will take 7-13 days to process;
  • Mr. Burrs will be invoiced a bill for the medical record request;
  • The hospital policy is that when a patient requests medical records for treatment purposes, there is no charge for the service of providing those records.  If the request however; is for personal or legal reasons, there will be a charge to provide the records;
  • Crittenton Hospital uses Medical Records Online, Inc. (“MRO”), a third party provider based in Pennsylvania,  to fulfill all medical record requests;

To vaccinate or not to vaccinate?

When a child is born he has to be vaccinated. He is supposed to be given 29 vaccines between birth and six years of age. He has to be immunized against Hepatitis B; Hepatitis A; Rotavirus; DtaP; Haemophilus influenzae type b; Pneumonia; Trivalent inactivated influenza; Attenuated influenza; MMR; Varicella; Meningococ; etc. The questions arise: why should a child be given so many vaccines in such a short period of time? Is a child at a great risk to get sick with at least one third of these diseases? Do we protect children from the diseases or just weaken their immune systems?

Nowadays, there are a lot of disputes concerning vaccinations. Based on the various facts parents should decide what is best for their children. Nonetheless, “All 50 states require vaccinations for children entering public schools even though no mandatory federal vaccination laws exist. All 50 states issue medical exemptions, 48 states (excluding Mississippi and West Virginia) permit religious exemptions, and 20 states allow an exemption for philosophical reasons”. (Vaccines: ProCon.org)

What are the PROs of vaccinations?

  1. Vaccines can prevent serious illness and death.
  2. When a vaccinated child gets sick with the disease he has been vaccinated against, he usually has milder symptoms with less serious complications than an unvaccinated child that gets the same disease.
  3. When diseases seem to no longer exist, outbreaks can still occur if children are not vaccinated.
  4. The US Court of Federal Claims ruled that the “theory of vaccine-related causation of autism is scientifically unsupportable.”
  5. Vaccines produce significant economic benefits for society.

    However, let us look at some negative sides of vaccinations. So,…

What are the CONs of vaccinations?

  1. Vaccines are often unnecessary in many cases where the threat of death from disease is small.
  2. Common childhood vaccination can cause serious reactions such as shock, paralysis, and sudden death.
  3. Vaccines can trigger auto-immune disorders such as arthritis, multiple sclerosis, lupus, Guillain-Barré Syndrome (GBS), and other disorders.
  4. Vaccines can cause brain inflammation (encephalopathy) which can lead to death or permanent brain damage and disorders such as autism, ADD/ADHD, and other developmental problems.
  5. Vaccines clog and disrupt the lymphatic system with large foreign protein molecules which may lead to leukemia and lymphoma.
  6. All vaccines cause immune system suppression, and can permanently damage the natural immune system.
  7. Children should not be required to receive the DPT vaccine. Some studies have shown that children who receive the DPT vaccine exibit shallow breathing which has been associated with sleep apnea and may be a causal factor in sudden infant death syndrome (SIDS).
  8. Children should not receive the hepatitis B vaccine. Hepatitis B is a blood-born disease and is primarily spread by sexual intercourse and intravenous drug use. In addition, researches have found that immunization with the hepatitis B vaccine is associated with an increased risk of developing multiple sclerosis.
  9. Young girls should not receive mandatory vaccination for HPV. It is a relatively new vaccine which was approved in 2006. The long-term effects are unknown. The vaccine gives rare but dangerous side effects and it is not worth the risk since the vaccine only protects against two of the 15 strains of HPV that may cause cancer of the cervix, 20 – 40 years after an individual is infected.
  10. One of the biggest role of vaccination is to generate profits for manufacturers and financial donations for medical organizations that endorse vaccines.
  11. Children should not be vaccinated against rotavirus. According to the CDC, rotavirus lasts only a few days and can be treated with fluids to rehydrate the patient. Only one in seven children requires hospitalization for the virus.

The research above (the pros and cons of vaccinations) is based on Vaccines: ProCon.org research

 HRSA (Health Resources and Services Administration) provides with a vaccine injury table. The table explains injuries that are presumed to be caused by vaccines. It also lists periods of time in which the first symptom of the injurries must occur after receiving the vaccine. If the first symptom of the injury occurs within the listed time period, it is presumed that the vaccine caused the injury.

Vaccine Injury Table

Hence, it is still unclear whether children should be vaccinated or not. If they should, is it necessary to follow “Immunization Schedules”? Every parent will be taking risks anyway. If you made a decision to give vaccines to your child you have to make sure that the child is 100% ready to receive them. He should be checked thoroughly by a pediatrician. You should check the date of expiry of the vaccine your child is going to receive. You have a right to know in what conditions a certain vaccine should be kept and make sure that it has been kept accordingly. Every step should be taken seriously without any negligence.

If some injuries occur after vaccination you can apply for National Vaccine Injury Compensation Program.
